These Terms & Conditions ("Terms") govern your use of the Nexa Point Group website (the "Site") and our managed IT, cloud, and cybersecurity services (the "Services"). They form a legally binding agreement between you and Nexa Point Group Limited, a company registered in England and Wales (Company No. 16323341), with its registered office at 71–75 Shelton Street, London, WC2H 9JQ ("Nexa Point", "we", "us").

By accessing the Site or using the Services, you confirm that you accept these Terms and agree to be bound by them. If you do not agree, you must not use the Site or Services.

2. Use of the Website

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that breaches applicable local, national, or international law or regulation.
• Transmit any unsolicited or unauthorised advertising or promotional material.

4. Client Portal

Access to the client portal is restricted to authorised users with valid credentials issued by Nexa Point. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us immediately at info@nexapoint.co.uk if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate portal access at our discretion, including where we believe security has been compromised.

5. Services

Specific terms governing the provision of our managed IT, cloud, and cybersecurity services are set out in the service agreement or statement of work entered into between Nexa Point and the client organisation. In the event of any conflict between these Terms and a service agreement, the service agreement shall prevail.

We will use reasonable skill and care in providing the Services but do not guarantee that the Services will be uninterrupted or error-free at all times.

6. Limitation of Liability

To the fullest extent permitted by law:

• We exclude all conditions, warranties, representations, or other terms that may apply to the Site or its content, whether express or implied.
• We will not be liable for any loss or damage arising from your use of, or inability to use, the Site or its content.
• Our total liability to you in respect of any losses arising under or in connection with these Terms shall not exceed the greater of £100 or the amounts paid by you to us in the three months preceding the claim.
• We will not be liable for any indirect, special, or consequential loss, including loss of profits, loss of business, or loss of data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

The Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
